This website provides evidence for the following case because small claims court in Los Angeles has required all cases to be held remotely due to the Covid 19 pandemic and part of the evidence includes video which could not be printed out and filed with the clerk of the court. The court has been instructed to view video evidence on this website.

The court should be aware that the defendant obtained a restraining order against me by use of false testimony, lies and conspiracy theory and because I sent tweets to his father trying to locate him after he hid from me to avoid being taken to small claims court. This website will prove that defendant engaged in willful vandalism against my property out of hatred towards me. The evidence here will prove defendant knew damage was occurring to our cars and he chose not to instruct his gardeners to stop blowing granite sand directly at our cars. He liked that it was happening, moved out of his house to hide so I couldn't serve him this lawsuit. Defendant was the only one who had the authority to make his gardeners stop blowing sand at our cars, he chose not to and it continued for an additional two months until that fateful day I became aware of where he was hiding and served him this case. The willful vandalism then stopped the same day. The aftermath of his actions left over $6000.00 in damage to two cars and caused me additional expenses which now border $10,000.

Email I received on 05/06/2021 from one of the worlds largest manufacturers of car windshields.



This area of my neighbors yard once had decomposed granite sand covering it.  




This area is 9 feet from my car parked in my driveway, and the missing sand is missing because it was blown with a backpack leaf blower at 245 miles per hour wind to land upon my car. This caused substantial damage to my car when I used my windshield wipers. 

When I told my neighbor we needed to discuss it, he moved out and continued to do it which then caused damage to my wife's car. It was done as an act of hatred toward me because my neighbor doesn't like me. 

The reason he doesn't like me is because 5 years ago when he bought the house next door, I told him I didn't want to breathe his secondhand cigarette and pot smoke everyday. 

He and his friends were heavy chain smokers and it would fill my living room every day all day because my home is downwind from his. Because of his hatred toward me, he chose to vandalize my cars recently as a way to get back at me. 

This is criminal behavior orchestrated by him, the defendant. As a result, I've filed this lawsuit against him in small claims court. 

This website will show malicious criminal intent to cause property damage which is felony vandalism.

The dust you see is also silica dust from the granite based groundcover. Silica dust is a carcinogen that causes silicosis, cancer and other organ damage. Every Thursday this dust has blanketed our property against my wishes for good reason. See the MSDS Sheet HERE. 




Example of how powerful a leaf blow can be. This is just an example I found on You Tube and its a consumer level leaf blower, "NOT" a more powerful commercial grade blower like the defendants gardeners use in the above video. 







This shows the loose sand in defendants yard 9 feet from where I park my car. The blower has blown it all away and onto my car little by little each week.


 

It was this sand that landed on top of my car every week. I repeatedly told the defendant to tell his gardeners to stop blowing his sand all over my car, he laughed at me and it kept happening. My windshield became severely scratched as a result. The sand is completely gone due to them blowing it at our cars.




Method I Used to Determine How Granite Sand Scratched our Windshields:

I found through research that granite is known to easily scratch glass according something called the Mohs Scale of Mineral Hardness. The sand covering the defendants front yard is granite sand.

My car is a Mercedes Benz S550 Sedan pictured below on January 2020 the day I bought the car. Nine months later......

November 7, 2020 I discovered severe scratches in my windshield.  

Upon noticing severe scratches in the glass, I took my car to Beverly Hills Mercedes to have it checked out. Upon the dealership staff inspecting the car, they discovered a brown sandy residue substance all along the bottom of my windshield and beneath my wipers. This was the sand missing from the defendants front yard which was 9 feet from my car, and I'm told by the dealership sand has scratched my windshield and it would need to be replaced at a cost of $3432.54

November 14, 2020
At first I considered this an accident and sent this text to the defendant. I then confronted him when he returned from England a week later. He said it wasn't his problem.









When the defendant returned from England I asked him to talk to me about the damage to my car, he ignored me; said it wasn't his problem. I then said to him if he doesn't discuss it, I will take him to court. During this time I also called his gardener 3 times and left messages to call me and discuss this, I was ignored.



Proof Defendant Knew Damage was Happening to our Cars, Yet It Continued to Happen

Its important to point out that the defendant did in fact receive my texts about the damage his sand caused to my car on November 14, 2020. We know this because one week prior I sent defendant this text about how his roofer wasn't doing such a great job on his house. As you can see by defendants response, he doesn't appear to be fearful of me as he testified in court recently to obtain a restraining order against me. Sometimes people make up stories to get restraining orders because they don't want to be held accountable for willful vandalism. That's what has happened in this case.

This text was from me to defendant on November 7, 2020. My wife and I thought it'd be neighborly to tell defendant his roof was getting wet because he'd asked my wife to watch his roofers while he was England.






Notice one week later I sent him a text about my windshield which he ignored; that text stream is above. This proves that he knew the sand was damaging my car after he moved out the end of November because he claimed he feared for his life. He did nothing to stop his gardeners from continuing to blow sand at our cars and it continued for the following two months.




Time to think about it
I then gave defendant and his gardener some time to think about it and by the end of the month, the defendant moved out of his house and disappeared so I could not take him to court. He placed his home up for rent and continued to use the same gardeners to care for the property.


At this point, defendants gardeners kept coming every week and they continued to blow the sand at defendants request. I explained to the gardeners that the sand had caused damage to my car but they did not care and kept blowing the sand because the defendant wanted them to do it. 


December 10, 2020
I receive the below text from defendants gardener Arcides; the guy who owns the landscaping company. 



For the 4th time after 3 phone calls, I told Arcides to please tell his guys to stop blowing the sand because its caused damage to my car, but he refused and it continued every week until I served the defendant in this case. Once defendant was served, they finally stopped blowing the sand, however by then, my wifes Mini Cooper was also damaged.






My wife and I found this when we opened the hood of her Mini Cooper to replace the washer fluid in late January. The sand is all over her engine compartment just below the windshield. Her windshield has been scratched in circular patterns corresponding with how the wipers move across the glass. The dealership said it would need to be replaced due to the scratches in the glass.

Pictured here is the fresh air intake vent on my wife's Mini Cooper. Every time she turns on her air conditioner, the toxic granite dust is pulled from here and circulated inside the cabin and into her lungs. Although there's a filter, it does not catch all the micro particles of silica dust according to NIOSH -The National Institutes of Occupational Safety and Health. Silica dust requires forced air respirator to protect human health. More on that HERE




The scratches on our Mini Cooper windshield can best be seen when driving towards sunlight. Because the glass is clear, I've been unable to take pictures that show the scratches. The windshield will have to be replaced due to the damage the granite sand has caused. The cost is: $2707.79











I have dated video each week from December after defendant moved out, until the end of January when I served him in this case. Each video is short and dated in my phone just to prove that defendants gardeners continued to use a blower on the sand after I made them all aware of the damage they were causing.

Notice in the last 5 seconds of this video the gardener out by the trash cans on the street sees me filming and tried to get his partner to stop blowing the sand by waving his hands in the air. He realizes I'm filming him blowing the sand more than a month after they were told the sand damaged our cars.

Defendants gardeners finally stop blowing the sand because I was able to locate the defendant and have him served. He thought that he could continue to deface our cars and I wouldn't find him, but I did and it came to a screeching halt.

Between December and February I kept my car at a different location because the defendant was motivated to cause more damage to it. This caused me additional expenses as I tried to protect my car from further damage. I rented a car for a month at a cost of $1404.30



When people damage your car, there's an expectation that they would participate in a resolution to correct it. Defendant instead has tried very hard to cause further damage and disrupt our lives. He filed a SPITE case against me after having him served as a method to intimidate me from taking him to court. This led the defendant to start harassing me and my wife which went on from the beginning of February for nearly 3 months until he got a restraining order against me based on fabricated lies about me. He used his wealth to hire a lawyer and paid witnesses to lie for him in court to achieve his goal for a restraining order.

Plus Misc Expenses related to defendants defiant behavior and making me have to file this case. Those additional charges bring the total above $10,000 but I've capped it at $10,000.


Defendant Chose Not to go to Court

It should be noted that defendant was given an opportunity to appear on the Judge Judy Show and declined the shows producer Makita Bond's offer. 

The producer explained to defendant that if he lost in this case, the show would pay me the damages on his behalf. He declined her offer and instead continued his defiance against me and my property. Below is a screenshot of the producers letter and email about her conversation with defendant.

Judge Judy Show producer Makita Bond reached out to defendant to discuss option for handling this dispute on her show. Defendant declined her offer because during this time, defendant was hiding at his dads house trying to avoid going to court. Defendant had no intention to do anything other than continue causing as much damage as he could to our property.














This is just one reason of many you shouldn't blow granite sand, the dust from it is toxic.

Installed Improperly


Its recommended decomposed granite be installed on flat level ground. Defendants yard slopes.

Lay 2 inches of product in the area, then use a vibrating soil compactor on it until its hard. 

Then place 2 more inches on top of that and repeat the compacting process until its smooth and hard.

Its recommended if you have trees, to use a garden rake to gather leaves. Blowing it will only blow away the sand as it becomes loose, requiring you to replace it as it erodes which is what happened in this photograph, also see video:

This is the type blower the defendants gardener uses. Its a very powerful commercial grade backpack blower that blows 245 Miles Per Hour wind. Thats stronger than a category 5 hurricane.

This is the defendants front yard, notice how it slopes down toward the sidewalk. Its recommended to only install this type of groundcover on flat level land. He also did not use 4 inches of product and the entire area has loose material on the surface. My point here is that the defendant installed it wrong which contributed to the hazards of loose material being blown by the gardeners.

I have no other conflict with the defendant other than the damage the sand has caused to our cars and his malicious intent to destroy our property after he was told to stop.






Willful Vandalism which Shows Criminal Intent to Damage Plaintiffs Property after Defendant was asked to STOP


Evidence that defendant was aware of the damage that blowing the sand was causing as this website was tracking all visitors starting in early December through today, here are those tracking reports. Evidence was added to this website as it was occurring between Early November Until NOW. I sent defendant and his parents numerous messages which led to each of them to visit this website to see what was happening and it continued to happen even after they were all aware of it. If thats not criminal then I don't know what is.

Reports show number of visitors from their perspective city, and the graph at the top shows number of times each visitor between particular range of dates came to this website to learn what was happening. Yet it continued to happen. Defendant had ample opportunity to call off his gardeners from blowing the sand and chose not to because he wanted to cause damage to our cars out of hatred towards me.

This tracking software is quite inadept and available to prosecutors to prove criminal intent if needed.

Each city represents where the defendant and his parents were at when looking at the evidence.

Defendant likes to claim I scratched my own windshield by using the product demonstrated in the below video because I mistakenly left an uninformed review claiming that it did. I later removed that review once I learned the facts.


Video demonstration using the spot remover which I at first thought may have caused the scratches to my windshield. After careful research I discovered it was impossible to scratch glass. In this video, a company rep uses the same product on the hood of a car and windows which does not leave any scratches because its a gel based product with no abrasives in it.

Plenty of satisfied customers in the comment section beneath this video on you tube here in all there are 183 comments since September 21, 2020.


The only substance in the area of our homes that can scratch glass is the granite sand in the defendants front yard and its science based evidence. If defendant had discussed the matter with me early on, he could have saved himself a lot of money he's paid his lawyer to help develop conspiracies against me. Learning the facts and science is always the best thing.

Unfair Judgement
Although I won my case against Haroon Ishrak, this judgement doesn't even come close to covering the damages Haroon Ishrak has caused to our property. The repair estimates on this website depict the actual damages he's caused us and the court was unfair at rendering this incomplete judgement.
